The Commonwealth Government Role in Coastal Planning and Management

Where?

From 3 NM to 12 NM out to sea and beyond to the 200 NM Exclusive Economic Zone.


Responsibility

Interstate and overseas trade and commerce, fisheries in Australian waters beyond state boundaries, defence, lighthouses, quarantine, corporations, petroleum and minerals beyond 3 NM, Aboriginal and Torres Strait Islander affairs, territories, external affairs such as treaties, taxation and financial assistance to states.

Resource 6

The State/Territory Role in Coastal Planning and Management

Where?

Within State or Territory boundaries which includes the water and seabed up to 3 NM out to sea.


Responsibility

  • All areas not specified as Commonwealth Government responsibilities, including: planning, development control, beach protection, fisheries management within the 3 NM boundary (and for specific fisheries co-managed with the Commonwealth Government), forestry, environmental protection, creation of national parks and reserves, aquaculture, port authorities, management of most public land, specific statutes for coastal protection.

  • States give power to the relevant authorities and related agencies responsible for: water, sewage, port services, roads, pollution management, national parks and reserves.

  • 'Lands Acts'

  • 'Local Government Acts'

  • Making, approving, altering regional environmental plans, directing the making and approval of local environmental plans.

  • Hearing appeals against local decisions or conditions of approval.

  • Providing system for Environmental Impact Assessment.

Local Government Role in Coastal Planning and Management

Where?

Within boundaries of local government.


Responsibility

  • Day-to day implementation of regional and local environmental plans and local aspects of state and federal programmes (eg. Coastcare projects)

  • Public health, waste disposal, swimming, foreshore management, tree preservation, management of land (including bush land), building approvals, development approvals, rezoning and subdivision of land (in compliance with state guidelines).

A wide variety of laws and regulations required to implement and administer their areas of responsibility. Committees with authority to plan and implement coastal policies (which must conform to state guidelines), including representatives from the public.
